Quintana was booked into Liberty County Jail the next day on the unrelated charge of cruelty to a non-livestock animal.

The father of three children rescued from a pond in Texas was arrested the day after the incident on an unrelated animal-cruelty charge, authorities said.

Domingo Quintana, 61, was booked into the Liberty County Jail on Tuesday on a misdemeanor charge of cruelty to a non-livestock animal, Click2Houston, ABC13 and KHOU reported. His bond was set at $5,000.

Charging documents say investigators found malnourished animals on the property, according to ABC13, the Houston Chronicle and Yahoo News. The documents describe an emaciated cat confined inside a non-climate-controlled shop building with no food or water. KHOU also reported deputies found malnourished cats, dogs and a few chickens.

The arrest came just a day after deputies pulled Quintana's wife and three children from a pond outside their home.

Liberty County Sheriff's Office Capt. David Meyers said at a Monday, Sept. 29 press conference that deputies were contacted around 5:50 a.m. and found a mother and her three children -- ages 15, 11 and 6 -- by a pond in front of the house.

Meyers said the mother and the 11-year-old girl were in critical condition, while the 15-year-old girl and 6-year-old boy were stable. He added that the 15-year-old was conscious and talking at the hospital.

"She's very tired," Meyers said. "She's been through a dramatic incident involving her siblings and parents," Meyers said.

According to Meyers, deputies pulled the mother from the water; she had a pulse but was not breathing on her own when removed. He also said investigators had been to the address before, but it was not clear if the previous call involved the same family.

Meyers noted that Quintana was the one who called 911, and was at the scene helping deputies when they arrived.

The father claimed to dispatchers that his wife had given the children NyQuil — and possibly alcohol — before taking them to the water, per Click2Houston, KHOU and KBTX.

Authorities have not filed charges in connection with the near-drowning; the investigation remains active, the Houston Chronicle, ABC13 and Click2Houston report.

Child Protective Services has taken custody of all three children, and they will be placed in foster care once released from the hospital, per ABC13, CW39 and Click2Houston.

At the press conference, Meyers said the investigation remains ongoing and emphasized that deputies are still gathering evidence.
